These rules must be respected by all who come to DaDungeon regardless of the reason. All individuals at DaDungeon agree upon entrance

If a court of competent jurisdiction deems any portion of this agreement unenforceable it shall not affect the enforceability of the other portions of the agreement.  

1.       The word(s) “DaDungeon” have been given as a nickname to this private residence. Due to the unique atmosphere individuals request to use the house for individual meetings, photography, personal parties and the like. Therefore the individual hostess/host becomes liable in all ways, without limit.

2.       The homeowner is not responsible in any way for any activity whatsoever with neither the individual nor the attendees who accept full legal liability in all way without limits.

3.       The homeowner will not be onsite and has been guaranteed by the individual that the individual and those who enter will uphold all legalities, local to federal, without limit and regardless of lack of knowledge by the person using the place.

4.       The purpose of this Agreement is to insure that everyone is committed to the same high standard of behavior and safety.

5.       I agree that I will insure that practices and occurrences are legal, responsible, respectful, safe, sane, and consensual.  

6.       Upon entrance this becomes a legal confidentiality agreement so that all parties understand that the identity and actions of everyone shall remain confidential.  

7.       I will not disclose any event location or personal identifying information or photography belonging to anyone other than myself.

8.       I subscribe to the principles of the First Amendment, whereas people have the right to peacefully assemble and express themselves.

9.       No illegal acts are allowed including but not limited to prostitution or solicitation.  No sexual services are offered.

10.   I understand that I am not purchasing, requesting or expecting any sexual acts or illegal activity. 

11.   I am capable of entering into this legal agreement, being over the age of eighteen and will present legal photo identification before entrance. 

12.   I am responsible for false disclosure and accept the legal ramifications and any legal fees occurring from such action. I agree I will not misrepresent my identity or impersonate anyone.

13.   I am attending ONLY for my own personal entertainment. I affirm I am neither a law enforcement officer, postal official, private investigator, nor operating under an assumed name or in cooperation with any federal, criminal, media, legal or family service investigation. I am not seeking out evidence that may serve as the basis for any charge of violating federal, state, local laws nor ordinances. I am not seeking to entrap or gather information for any legal, criminal, media related, or family associated issue(s). 

14.   I agree to not speak with any media person, governmental, law enforcement (state, local, nor federal) officer, nor private investigator, nor any one from a social service nor division of family services in regards to any person, location, type of activity, things seen, heard, or experienced by yourself and/or by attendees I will not disclose any information nor make an implication of any activity whatsoever.

15.   As part of this Confidentiality Agreement, I affirm I may legally decline to answer questions, using Fifth Amendment rights.  

16.   We reserve the right to refuse entrance to anyone at anytime and without reason.

17.   Understand that these rules of DaDungeon must be followed and respected in all regards at all times. These apply to all who arrive regardless of what or whom is using the house.

18.   No rules established by a host, party planner or individual would negate these rules in any manner.

19.   All attendees must be at least twenty-one years or older unless the party is designed for people eighteen and older with no alcohol allowed on premises.

20.   Impairment by alcohol or drugs means that you are not capable of negotiation.

21.   People who are impaired will be asked to leave or may be restricted to a certain area. 

22.   We are not responsible for lost, broken or stolen articles.

23.   Do not touch a person without permission.

24.   Do not touch any toys, novelties, items or equipment without permission.

25.   Do not attempt to use equipment you are not skilled in.

26.   Follow instructions.

27.   We reserve the right to search bags, totes, purses and such as well as the individual upon arrival or departure. 

28.   I hereby state that I am not currently nor have I participated in illegal activities of any sort.

29.   I affirm that I have never been convicted for nor am in trail regarding any criminal act including but not limited to domestic violence, child abuse, homicide, infanticide, pedophilia acts, zoophilia, drug or alcohol trafficking, proxenetism nor any other illegal activity. Any domestic violence, child abuse, pedophile, zoophile and illicit practices, publishing, discussions, editions, or activities shall not be introduced or presented in any manner. Such actions will be reported to authorities.

30.   At our sole discretion, we may determine that law enforcement officials should be notified. In doing so we may provide any and all information we have and cooperate in full with the appropriate officials without notice to you. We retain the right to disclose to enforcement officials information, personal identification information, and Internet Protocol addresses pursuant to a subpoena or court order or, in circumstances where we deem appropriate.

31.   Waiver, Indemnity Release: Upon entrance I hereby release DaDungeon home owner and affiliates from any and all claims, demands, debts, obligations, damages (perceived, actual or consequential), costs, and expenses of any and all kinds whatsoever, whether known or unknown, suspected or unsuspected, disclosed or undisclosed, that I may have against them arising out of or in any way related to such disputes.

32.   Upon entrance I hereby agree to waive all rights that may limit the efficacy of such releases. I agree to indemnify and hold DaDungeon homeowner or any person related to DaDungeon harmless against any and all claims and expenses arising from any association or use of the premises.

33.   DaDungeon expressly disclaims any and all liability from anyone whomsoever who enters.

34.   DaDungeon is not responsible in any manner for your actions or the actions of others.

35.   I hereby state that I accept full responsibility upon myself. I accept that DaDungeon is not liable for conduct by anyone.

36.   I agree that I am entering at my own risk. I hereby give consent to partake in any and all activities at my own risk including but not limited to activities of giving and/or receiving intense sensations, role-playing and/or an exchange of power.

37.   I waive all responsibility for any injury that I may receive during any and all activities at this location.

38.   I accept that it is my responsibility to check things, furniture and equipment for safety and hold all others harmless.

39.   If something is broken by me or in association with me, I agree to immediately pay full retail price for the item to be replaced.

40.   I accept full responsibility upon myself in all regards. I release and discharge the premise owners from any and all liability that might arise or be perceived.

41.   All disputes and respective assigns, attorneys, and successors of any kind whatsoever, arising from this agreement shall be resolved by arbitration in accordance to the rules of the American Arbitration Association. Arbitral claims shall include, but are not limited to, tort and contract of all kinds, and all claims based on federal, state, or local statute, laws and regulations.

42.   Arbitration shall be final, binding and the exclusive remedy for all parties for all claims with the fees of the arbitrator being paid for by the losing party, as determined by the arbitrator.  

43.   No illegal substances or items are allowed. You will be denied entrance and officials will be contacted. 

44.   Do not speak of illegal activities. You will be reported.

45.   For the safety of others there may be no activities that could involve bodily fluids such as but not limited to; blood, urine, feces, spittle, vomit or any other body fluid.

46.   If you see or hear something illegal or contrary to these rules then you then have become involved as an accomplice so it is suggested that it be reported immediately.
